A Confidential Settlement for a Hotel Owner due to Insurance Agent’s Negligence

Our client owned a hotel that was severely damaged by fire. Before the fire, our client obtained an insurance policy on the hotel through his independent insurance agent. The insurance agent prepared the commercial insurance application on behalf of our client, but unfortunately included some information about the hotel that the insurance company thought was false.

After completing the insurance application, the insurance agent only sent the signature pages to our client to sign, not the entire application. Our client, who trusted that his insurance agent had properly completed the application, signed the signature pages without knowing that the agent may have included inaccurate information on the application. The inaccurate information was included on the pages of the application that the agent didn’t send to our client for review.


When our client submitted a claim to his insurance company for the hotel fire, the insurance company didn’t immediately pay the claim. Instead, the insurance company accused our client of making numerous “misrepresentations” on his insurance application and denied the claim, stating that our client had misrepresented the size and occupancy of the hotel, among other inaccuracies. After suing the insurance company and reaching a confidential settlement with it, we then sued the insurance agent for negligence and reached a successful settlement for our client.
